[39] From a functional perspective, a society in which government officials have a wide margin of discretion has a low degree of “rule of law”, while a society in which government officials have little discretion has a high degree of “rule of law”. [39] Maintaining the rule of law may sometimes require punishing those who commit crimes justified by natural law but not by law. [40] The rule of law is therefore somewhat at odds with flexibility, although the latter is preferable. [69] Positions and methods of servitude In countries such as China and Vietnam, the transition to a market economy has been an important factor in the evolution towards the rule of law, as the rule of law is important for foreign investors and economic development. It is not clear whether the rule of law in countries such as China and Vietnam will be limited to trade issues or extend to other areas and, if so, whether these effects will improve the prospects for related values such as democracy and human rights. In Thailand, the police are popular with the rich and corrupt. In Cambodia, judges are representatives of the ruling political party. [62] Others argue that the rule of law has survived, but has been transformed to allow directors to exercise their discretion. For much of American history, the dominant notion of the rule of law in this environment was a version of A.V. Dicey`s: “No man is punishable or may lawfully suffer in body or property, except for a clear violation of the law, which is established in the ordinary legal manner before the ordinary courts of the land.” That is, individuals should be able to challenge an administrative order by bringing an action before a court of general jurisdiction. The best-known arguments in favor of formal interpretation have been advanced by A.V. Dicey, F.A.Hayek, Joseph Raz and Joseph Unger. The American democratic system is not always based on the simple majority rule. Certain principles are so important to the nation that the majority has agreed not to interfere in these areas. For example, the Bill of Rights was adopted because concepts such as freedom of religion, freedom of expression, equal treatment and due process were considered so important that even a majority should not be allowed to change them. The rule of law is a set of principles or ideals aimed at ensuring an orderly and just society. Many countries around the world strive to uphold the rule of law, where no one is above the law, where everyone is treated equally before the law, where everyone is held accountable under the same laws, where there are clear and fair procedures for enforcing laws, where there is an independent judiciary and where human rights are guaranteed for all.
